So,
I want to make a doll for me. Is it illegal to make a doll after a license character. For example: avatar, Disney, Halloween characters, ect.
I get things have copyright but…. What if we want it for ourselves. I get inspired and just was curious. Does this mean we can’t show pictures if we do make something? So many questions I have.
I have never made an alternative soooooo I don’t want to mess up.
The problem lies in selling, and mostly the wording of it. It seems to be okay if you say “inspired by…” or if you don’t use the official name at all. But I’m not a lawyer.
I’ve seen someone sell a “Snow White” baby…and there’s tons of avatar babies. If it’s for yourself and you’re not ever going to advertise it, I don’t see how that could pose a problem. Even if you did decide to sell it….you’re not mass producing anything and claiming it IS a “disney” doll.
I’m in quite a few crochet groups. We sell our items on Etsy and other places. We are not allowed to make Disney characters to sell. Disney has a whole team dedicated to watching this. However, we are allowed to make them and give them to our children and grandchildren. That is allowed.
So can we show pictures or is that illegal too? I just don’t want to be flagged for an illegitimate item or doing wrong just because I get excited or want to make something for myself. I wanted to make a spooky baby but if I do and show pictures will people flag me as doing wrong?
I made Jasper and Clover and put them up for sale as “Elf on a Shelf” . I was notified I could not use the name and had to rename them. This was on etsy. If it is for you and you don’t advertise them for sale
with the name say Avatar , you can use photos on here I think.
