Is it illegal to take kits and paint like avitar babies or other babies? I know people have done it but can’t remember the answer. Like grinch and so on?
I believe that if something is trademarked than yes it is illegal. I think people can get away with it by saying inspired by the Grinch or Avatar inspired but cannot call it a Grinch or Avatar or other trademarked item.
ahh, I see! I have so thought about making a fantasy baby but don’t want to get in trouble!!!
The Grinch situation was that someone had sculpted and then mass produced the vinyl sculpt called the grinch (correct me if I’m wrong). If you make a grinch doll and sell it it’s fine, just leave the name out of the title and you can say “fan art” “inspired by” etc
You are making me excited!
I think I want to make a fantasy baby!!
Baby Aang would be so cute!!! He would have to have an Appa stuffy and a Momo
Baby what?
I think my son would love that!
Just to jump in here with my experience…I have an Etsy shop and in learning about what can be sold there, I found out that it is not enough to say “_______inspired”. Disney and other major (and minor) corporations have done sweeps on Etsy and other such sites and have closed down businesses, fined the owner(s), and took the merchandise in question. The only way to legally sell things like that is to get a license from the company that created it, and that’s often very expensive.
I saw one on Facebook a while back it was really cute!!
Aang from The Avatar - the last air bender
I think @estelle meant avatar as in the blue “aliens” from the Avatar movie…
Oooooh Aang would be so cute
If you were to say “Grinch” it’ll be taken down. If you say “Christmas baby” instead, it should be okay.
Like, there are ‘manor elf’ kits out there, which are obviously house elves from Harry Potter, but since they’re not using any copyrighted names they can keep selling them.
I love the blue avatar babies there was an amazing artist who made those but I haven’t seen her selling them on reborns.com lately. I’d love to own one of them I don’t remember her name sadly. She did incredible work! I’ll see if I can find a pic. Her painting was phenomenal!
Archie would be a good Aang with those ears. Maybe a smiler? He was generally very lighthearted. I feel kinda like a giant dork now, but I am not sorry
If you are making it for yourself, you should be fine. However, you shouldn’t sell it, as you are profiting off someone else’s creation and don’t have the license to do so.
You can make them you just can’t name them as original characters.
@katieperry I wanted to find that nursery name as those avi-babies saved in my Favorites, but cannot find now where the heck FAVORITE folder went? Can someone guide me, please.
@Ladybuggirl can you post a link to your Etsy shop, please.
@YelenaRey, I feel that we must agree to disagree on this subject. It is my understanding that if you make something that is recognizable-for example, a headband with Mickey Mouse ears-if it is recognizable, it is against the law.
My shop is on vacation so you would not be able to see the items, otherwise I would not have a problem giving you the name of it. But I wonder, why do you ask?
This!
Because I love to learn about talents of this forum and we have a thred ‘what else can you do’ and I don’t remember you posted anything there. Why do you ask why I ask?
Also I see plenty of post on FB where Avatars called Avatars. None of them said that someone came and confiscated it. I took my Avi to the IDTS doll show and had no problem with that, except of a lot of attention.
